Danger® Service Acceptable Use Policy
THIS ACCEPTABLE USE POLICY ("Policy") sets forth the terms of acceptable use of the Danger Service by you ("You"). YOU AGREE THAT YOUR CONTINUED USE OF THE DANGER SERVICE SIGNIFIES THAT YOU HAVE READ, UNDERSTAND AND AGREE TO ABIDE BY THE TERMS SET FORTH BELOW. YOU ACKNOWLEDGE AND AGREE THAT DANGER, ITS SUPPLIERS AND ITS SERVICE PARTNERS MAY SUSPEND OR TERMINATE YOUR FURTHER USE OF THE DANGER SERVICE IF YOU VIOLATE THIS POLICY, AND MAY COOPERATE WITH AND ASSIST LAW ENFORCEMENT IN ANY RESULTING INVESTIGATIONS OF ILLEGAL CONDUCT.
1. Illegal Uses. You agree that You will not use the Danger Service to violate any applicable laws, rules, or regulations issued or promulgated by any competent government authority. Without limiting the foregoing, prohibited conduct includes using the Danger Service for the theft or infringement of copyrights, trademarks, trade secrets, or other types of intellectual property; fraud; forgery; theft or misappropriation of funds, credit cards, or personal information; or the export, re-export, or transfer of restricted software or data in violation of applicable export control laws.
2. Security. You agree that You will not use the Danger Service to violate, attempt to violate, or knowingly facilitate the violation of the security or integrity of any network, electronic service, or other system that is accessible through the Danger Service. Examples of prohibited activities include hacking, cracking into, monitoring, or using systems without authorization; scanning ports; conducting denial of service attacks; distributing viruses or other harmful software; or attempting to access or tamper with the non-public areas of the Danger Service.
3. Threatening or Defamatory Communications. You agree that You will not use the Danger Service to transmit or communicate any materials of a threatening or harmful nature, including threats of death or physical harm, or materials that are harassing, libelous, defamatory, or which facilitate extortion.
4. Offensive Materials. You agree that You will not use the Danger Service to distribute or facilitate the distribution of any offensive materials, including obscene, pornographic, indecent and hateful materials. You further agree that You will not use the Danger Service to access any of the foregoing materials, to the extent that such access may be prohibited by applicable law.
5. "Spam." You agree that You will not use the Danger Service for purposes of distributing e-mail "spam," bulk unsolicited instant messages, or any other form of unsolicited electronic communications distributed on a bulk basis to recipients with which You have no preexisting business or personal relationship. Additionally, You will not use the Danger Service to collect responses from "spam."
6. Interference. You agree that You will not use the Danger Service in a manner that interferes with any other user's ability to use and enjoy the Danger Service, that interferes with Danger's or its service partners' ability to provide the Danger Service, or that otherwise may create legal liability for Danger or its service partners in Danger's sole discretion. You will not use the Danger Service to violate another ISP's acceptable use policy or terms of service.
7. Violations. If You become aware of any violation of this Policy by any user, You will promptly report such violation to Danger.
8. Amendment. DANGER MAY AMEND THIS POLICY FROM TIME TO TIME IN ITS SOLE DISCRETION BY POSTING AN AMENDED VERSION OF THE POLICY AT THIS URL NO LESS THAN THIRTY (30) DAYS PRIOR TO THE EFFECTIVE DATE OF THE AMENDED POLICY. YOU AGREE THAT YOU WILL REGULARLY CHECK THIS URL TO READ ANY AMENDED TERMS THAT MAY HAVE BEEN POSTED. YOU FURTHER AGREE THAT ANY FURTHER USE THAT YOU MAKE OF THE DANGER SERVICE AFTER THE EFFECTIVE DATE OF THE AMENDED POLICY SHALL CONSTITUTE YOUR BINDING ACCEPTANCE TO ANY SUCH AMENDED POLICY.
